Q 15: How will imports be taxed under GST?

With Constitutional Amendments, both CGST and SGST will be levied on import of goods and services into the country. The incidence of tax will follow the destination principle and the tax revenue in case of SGST will accrue to the State where the imported goods and services are consumed. Full and complete set-off will be available on the GST paid on import on goods and services.

  1. suppose, imported goods, on reaching into India through nhava sheva port and the goods are mainly for Maharashtra State, what is the option for the importer to file for clearance of the goods. Does he/she need to file BCD or GST?

    1. Import under GST will be treated as interstate transaction and all taxes of import will clubbed in GST except Basic custom duty.
So importer will have to pay only BCD+IGST and cess on import.
Igst paid on import is completely creditable.
